LUXCard Terms & Conditions

1. Introduction

1.1 These LUXCard Terms & Conditions (LUXCard Terms) govern the purchase, use and redemption of digital gift cards issued by BDLJ Investments Pty Ltd trading as LUX4U (ABN 80 620 312 683) (LUX4U, we, us or our) known as “LUXCards”.

1.2 By purchasing, redeeming, accessing or using a LUXCard, you agree to be bound by:

(a) these LUXCard Terms;

(b) the LUX4U Website Terms & Conditions;

(c) the LUX4U Membership Terms & Conditions (where applicable);

(d) the applicable giveaway or trade promotion terms and conditions; and

(e) our Privacy Policy.

1.3 To the extent of any inconsistency, these LUXCard Terms prevail in relation to the purchase, use and redemption of LUXCards.

 

 

2. Nature of LUXCards

2.1 A LUXCard is a digital stored-value gift card that may be redeemed with participating LUX4U partner businesses for eligible goods and/or services.

2.2 LUXCards:

(a) are not credit cards, debit cards or financial products;

(b) are not reloadable;

(c) are not redeemable for cash except where required by law;

(d) may only be used with participating partner businesses;

(e) may be subject to additional conditions imposed by participating partner businesses.

2.3 LUX4U reserves the right to add, remove or modify participating partner businesses at any time.

 

 

3. Delivery and Access

3.1 LUXCards are issued digitally.

3.2 Following purchase, the purchaser will receive:

(a) a digital LUXCard;

(b) a unique gift card number; and

(c) a QR code associated with the LUXCard.

3.3 LUXCards may be printed by the customer, however LUX4U is not responsible for any unauthorised use resulting from loss, theft, forwarding or disclosure of the QR code or gift card details.

3.4 The holder of the LUXCard is responsible for maintaining the confidentiality and security of the LUXCard details.

 

 

4. Redemption Process

4.1 LUXCards may be redeemed only through authorised participating partner businesses.

4.2 Redemption occurs when:

(a) the participating merchant scans the customer’s LUXCard QR code or manually enters the LUXCard number into the LUX4U redemption system; and

(b) the transaction is approved by the LUX4U system.

4.3 A redemption transaction may be rejected where:

(a) insufficient balance exists on the LUXCard;

(b) the LUXCard has expired;

(c) fraud, misuse or suspicious activity is suspected;

(d) there is a technical or connectivity issue;

(e) the transaction breaches these Terms; or

(f) the LUXCard has been cancelled, suspended or voided.

4.4 LUX4U does not guarantee uninterrupted availability of the redemption system.

 

 

5. Partial Redemption and Balances

5.1 Partial redemption of LUXCards is permitted.

5.2 Any unused balance will remain available until the expiry date.

5.3 Customers are responsible for checking their remaining balance.

5.4 LUXCards are not reloadable.

 

 

6. Expiry

6.1 LUXCards expire three (3) years from the date of issue unless otherwise stated.

6.2 Any unused balance remaining after expiry will be forfeited to the extent permitted by law.

6.3 Expired LUXCards cannot be redeemed, reactivated, refunded or transferred.

 

 

7. Refunds

7.1 Change-of-mind refunds are not provided for LUXCards.

7.2 Nothing in these Terms excludes, restricts or modifies any rights or remedies available under Australian Consumer Law.

7.3 If a refund, chargeback or payment reversal occurs in relation to a LUXCard purchase:

(a) associated promotional entries may be cancelled or reversed;

(b) the LUXCard may be suspended or voided; and

(c) any remaining balance may be cancelled.

 

 

8. Promotional Entries

8.1 Eligible LUXCard purchases and/or eligible LUXCard redemptions may receive complimentary promotional entries into selected LUX4U giveaways or trade promotions.

8.2 The number of complimentary promotional entries available:

(a) may vary;

(b) may depend on the value of the LUXCard purchase or redemption;

(c) may depend on whether the customer holds an active LUX4U membership;

(d) may depend on the customer’s membership tier; and

(e) will be displayed on the relevant promotion pages or at checkout.

8.3 Complimentary promotional entries are not purchased separately and have no monetary value.

8.4 Promotional entries associated with a redemption are allocated to the active promotion at the time of redemption unless otherwise specified.

8.5 LUX4U reserves the right to:

(a) reverse;

(b) cancel;

(c) refuse; or

(d) invalidate

any promotional entries where fraud, abuse, manipulation, collusion or breach of these Terms is suspected.

 

 

9. Partner Businesses

9.1 Participating merchants are independent businesses and are not agents, employees or representatives of LUX4U.

9.2 LUX4U:

(a) does not guarantee the quality, availability or suitability of any goods or services provided by participating merchants;

(b) is not liable for any act, omission or negligence of participating merchants;

(c) is not responsible for disputes between customers and participating merchants.

9.3 Any issues relating to services or products supplied by a participating merchant must be resolved directly with that merchant.

 

 

10. Fraud, Misuse and Suspicious Activity

10.1 LUX4U reserves the right to suspend, cancel, refuse or investigate any LUXCard, account, redemption or promotional entry where we reasonably suspect:

(a) fraud;

(b) collusion;

(c) artificial transactions;

(d) manipulation of promotional entries;

(e) unauthorised use;

(f) chargeback abuse;

(g) self-redemption abuse;

(h) merchant collusion; or

(i) any breach of these Terms.

10.2 LUX4U’s decision in relation to suspected fraudulent or abusive conduct is final, subject to applicable law.

 

 

11. Liability

11.1 To the maximum extent permitted by law, LUX4U is not liable for:

(a) lost, stolen or unauthorised use of a LUXCard;

(b) delays or failures in redemption caused by technical issues;

(c) refusal of a merchant to provide services outside the LUXCard balance;

(d) business closures or changes to participating merchants;

(e) any indirect or consequential loss.

11.2 Nothing in these Terms excludes any rights under Australian Consumer Law that cannot lawfully be excluded.

 

 

12. Amendments

12.1 LUX4U may amend these LUXCard Terms from time to time.

12.2 Updated versions will be published on the Website and will apply from the date of publication.
